{"id":387,"date":"2014-01-04T12:18:11","date_gmt":"2014-01-04T18:18:11","guid":{"rendered":"http:\/\/www.glbtrt.ala.org\/news\/?p=387"},"modified":"2016-07-17T20:43:00","modified_gmt":"2016-07-18T00:43:00","slug":"supreme-court-recognition-of-same-sex-marriage-leads-federal-agencies-to-realign-benefits","status":"publish","type":"post","link":"https:\/\/www.glbtrt.ala.org\/news\/archives\/387","title":{"rendered":"Supreme Court Recognition of Same-Sex Marriage Leads Federal Agencies to realign benefits"},"content":{"rendered":"<p>Since the U.S. Supreme Court legalized federal same-sex marriage, several agencies have ruled that all same-sex married couples have federal rights even if the states where they live do not recognize these couples as married. Here are some of the agency changes that have already gone into effect:<\/p>\n<ul>\n<li><b>IRS:<\/b>\u00a0 all same-sex marriages will be recognized for all federal tax purposes, including filing, exemptions, dependents, and employee benefits. Couples also have the option to file amended returns for the past three tax years.<\/li>\n<li><b>Department of Labor:<\/b> In connection with employee benefit plans and beneficiaries, the terms \u201cspouse\u201d and \u201cmarriage\u201d in Title I of the Employee Retirement Income Security Act of 1974 and in related department regulations should be read to include \u201csame-sex couples legally married in any state or foreign jurisdiction that recognizes such marriages, regardless of where they currently live.\u201d according to the Labor Department. The terms &#8220;spouse&#8221; and &#8220;marriage,&#8221; however, do not include individuals in a formal relationship recognized by a state that is not considered a marriage under state law, such as a domestic partnership or a civil union.<\/li>\n<li><b>Department of Education:<\/b> Students in same-sex marriages in any state will receive the rights of opposite-sex married couples in regard to <a href=\"http:\/\/www.huffingtonpost.com\/2013\/12\/13\/student-loans-gay-couples_n_4441719.html?ir=Gay%20Voices \">federal college loan applications<\/a> as well as <a href=\" http:\/\/purpleunions.com\/blog\/2013\/12\/usa-two-more-federal-agencies-now-officially-recognize-same-sex-marriages.html \">more inclusive language about students and their parents<\/a>.<\/li>\n<li><b>Customs and Border Protection:<\/b> This agency has expanded the definition of \u201cmembers of a family residing in a household\u201d to include \u201clong-term same-sex couples and other domestic relationships,\u201d which will make it easier for couples to file joint customs declarations when returning to the country.<\/li>\n<\/ul>\n<p>The one agency that fails to recognize federal rights if same-sex couples live in a state not recognizing their legal relation is the <b>Social Security Administration<\/b>. Only legally married same-sex spouses who live in states recognizing marriage quality will receive retirement benefits, using \u201cstate of domicile,\u201d not \u201cstate of ceremony,\u201d for Social Security qualification.
